Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Exova desktop application, website, and related services (together, the “Service”), operated by Exova (“Exova”, “we”, “us”). By downloading, installing, or using the Service, you agree to these Terms.

1. Who may use Exova

You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

2. Your account

Some features require an account. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at security@tryexova.com if you suspect unauthorized use.

3. The Service

Exova is a developer tool in which an AI “CEO” and a team of AI agents plan, generate, and verify software based on your instructions. The Service runs generations through our managed LLM gateway.

AI-generated output can be inaccurate, incomplete, or unsuitable for a given purpose. You are responsible for reviewing, testing, and validating any output before relying on it, and for ensuring your use of generated code complies with applicable licenses and laws.

4. Plans, billing, and refunds

  • Free plan. Includes a monthly allotment of managed tokens at no charge.
  • Paid individual plans. Pro, Pro+, and Ultra are billed monthly or annually through our payments processor, Dodo Payments. Fees are stated at checkout and are exclusive of taxes unless otherwise noted.
  • Money-back guarantee. New paid subscriptions may be refunded in full if you request a refund within 30 days of your first payment.
  • Renewal and cancellation. Paid plans renew automatically until cancelled. You may cancel at any time from your billing dashboard; cancellation takes effect at the end of the current billing period.

5. Your content and ownership

You retain all rights to the inputs you provide and, as between you and Exova, to the code and other output the Service generates for you. You are responsible for your inputs and for the use of your output. You grant us a limited license to process your inputs and outputs solely to operate and improve the Service, subject to our Privacy Policy.

6. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy. We may suspend or terminate access for violations.

7. Third-party providers

The Service relies on third-party subprocessors, including model providers, hosting, and payments. A current list of subprocessors is available on our Subprocessors page.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output will be accurate or reliable.

9. Limitation of liability

To the maximum extent permitted by law, Exova will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or USD $100.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use after changes take effect constitutes acceptance of the revised Terms.
